Terms of Use

Timeless India Group ‘Website’ is published and maintained by the ‘Timeless India Group’, hereinafter referred to as “TIG. When you access or browse and/or use this ‘Website’ in any way, you accept without limitation, the terms and conditions set forth hereunder by “TIG”. 

In the case you access any of the associate-website (whether belonging to any partner or a collaborator of “TIG” or otherwise) through this ‘Website’, you understand and accept that such associate-site may have its own terms and conditions of use which are specific to such associate-website.

As a prior condition to the use of “TIG” ‘Website’, the ‘User’ warrants that they/he/she will not use this ‘Website’ for any purpose that is unconventional and/or illegal under any law for the time being in force either within or outside the territory of the Republic of India or in anyway prohibited by this Agreement and the Terms of Service, including both specific and implied. In addition, the User will not use this “TIG” ‘Website’ in any manner which could damage, disable, overburden or impair the ‘Website’ or obstruct any other party's use of this ‘Website;’ The User shall totally refrain from obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for, through this ‘Website’. These Terms and Conditions of Use and any additional terms that are posted on “TIG” ‘Website’ together constitute the entire ‘Agreement’ between “TIG” and the ‘User’ with respect to this ‘Website’ usage by the User.

Site Access Restrictions

This ‘Website’ is only for the User personal use. User shall not distribute, exchange, modify, sell or transmit anything they/he/she copies from this ‘Website’ including but not limited to any text, images, audio and video, for any kind of business, commercial or public purpose. Access to certain sections of this ‘Website’ may only be available to the enrolled/registered members. In order to become a registered/enrolled member, the User may be required to answer certain specific questions which may be mandatory and/or optional, in which case the User represents and warrants that all such informations the User supplies to “TIG” about themselves/himself/herself, and others, is fully accurate and true.

Content Copyrights

All materials on this ‘Website’, including but not limited to, audio, images, software, text, graphics, icons and anything that can be termed similarly (the "Content"), are protected by copyright under the international conventions and copyright laws. A user cannot use the “Content”, except as specified herein. The User shall agree to follow all instructions on this ‘Website’ limiting the way the User may use the Content. There are a number of proprietary logos, service marks and trademarks found on this ‘Website’ whether owned/used by “TIG” and/or otherwise. By displaying them on the ‘Website’, “TIG” is not granting the ‘User’ any licence or permission to utilise those proprietary logos, service marks or trademarks. Any unauthorised use of the “Content” may violate copyright laws, trademark laws, the laws of privacy and publicity. 

Protection of Third Party Rights

If this ‘Website’ contains any communication facilities like bulletin boards, chat rooms, access to mailing lists or other messages, the User shall agree to use the same only to send and receive messages and materials that are proper and related thereto. By way of example and not as a limitation, the User shall agree that when using the ‘Website’, the User shall not do any of the following:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns the rights thereto or has received all consents and permissions thereof as may be required by law. Upload or attach any files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another computer. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded. Falsify the origin or source of software or other material contained in a file that is uploaded. Advertise and/or offer to sell any goods or services, or conduct or forward surveys, contests or letters, or download any file posted by another User of a Forum that the User knows, or reasonably should know.

Uploading User Content on the Website

The User is prohibited from posting and/or transmitting any defamatory, libellous, obscene, pornographic, profane, threatening or unlawful material or any material that could constitute or encourage conduct that would be considered a criminal offence or give rise to civil liability, or otherwise violate any law.

“TIG” assumes no liability or any kind of responsibility arising from the contents of any communications containing any defamatory, erroneous, inaccurate, libellous, obscene or profane material. “TIG” may change, edit or remove any User material or conversations that are illegal, indecent, obscene or offensive, or that violates “TIG's” policies in any way. 

Timeless India Group, Rights on User Content

If the User sends any communications or materials to the ‘Website’ by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, and will be treated by “TIG”, as non-confidential. The User hereby gives up any and all claims that any use of such material violates any of their/his/her rights including moral rights, privacy rights, proprietary and/or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way “TIG” uses such material. Any material submitted to this ‘Website’ may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, transmitted, published, sold, and/or used by “TIG” anywhere in the world, in any medium.

Transmitted Material

Internet transmissions are never completely private or secure and “TIG” cannot guarantee complete security of the transmitted data. The User understands that any message and/or information that they/he/she sends to this ‘Website’ may be read or intercepted by others. Sending a message to “TIG” does not cause “TIG” to have any special responsibility to the User.

The copyright in the contents of this ‘Website’ belong to “TIG”. Accordingly “TIG” reserves all rights.

Force Majeure Circumstances

There can be exceptional circumstances or concerns beyond the control of service operators like the airlines, hotels, transportation providers where they may be unable to honour their confirmed booking arising from different reasons like; climatic conditions, labour unrest, insolvency, business exigencies, government decisions, unexpected operational and/or technical issues, route and flight cancellations etc. By using this ‘Website’ you hereby agree to the knowledge of such circumstances. If “TIG” is informed in advance of such exceptional circumstances or the situation where dishonour of a booking may happen due to unforeseen circumstances, it will make best efforts to provide a similar alternative or refund the specific component amount after reasonable service charges, only if supported and refunded by its respective service operator or supplier. “TIG’s” role being limited to only facilitating the booking services. The User shall not hold “TIG” liable for any delays or inabilities in performance whether completely or in part of its obligations due to any kind of causes that are not due to its acts or omissions and are beyond its control, such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism and/or other similar causes, problems at airlines, rails, buses, hotels or transporters end. In no event shall “TIG” and/or its partner service operators or suppliers be held liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of “TIG” or any other channels related to its partner service providers.

Disclaimer

The material in this ‘Website’ might include technical inaccuracies or typographical errors. “TIG” may make changes or improvements at any time in future. The materials published on this site are provided on an "As Is" basis, without warranties of any kind either expressed or implied by “TIG”. It does not warrant that the functions contained in this ‘Website’ will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make it available are free of viruses or other harmful components. It does not warrant or make any representations regarding the use of or the result of the use of the material on this ‘Website’ in terms of their correctness, accuracy, reliability, or otherwise, insofar as such material is derived from other service providers and suppliers such as airlines, hotel owners, tour operators, outfitters, transporters, cruise operators, and others.

The ‘User’ acknowledges that this ‘Website’ is provided only on the basis set out in these ‘terms and conditions’. User's uninterrupted access or use of this ‘Website’ on this basis may be prevented by certain factors outside our reasonable control including, without limitation, the unavailability, inoperability or interruption of the Internet and/or other telecommunications services or as a result of any maintenance or other service work carried out on this ‘Website’. 

The ‘User’ acknowledges that through this ‘Website’, “TIG” merely provides intermediary services in order to facilitate quality services to you. “TIG” is not the last-mile service provider to you and therefore it shall not be or deemed to be responsible for any lack or deficiency of services provided by any persons (airline, travel/tour operator, hotel, facility or similar agency) User shall engage or hire or appoint pursuant to or resulting from the material available in this Site. It shall not be held responsible for any misuse of the content posted on the ‘Website’ by a third party.

Modifications in Terms and Conditions of Use

“TIG” may add to, change, or remove any part of these Terms and Conditions of Use at any time, without notice. Any changes to these Terms and Conditions of Use or any terms posted on this ‘Website’ apply as soon as they are posted. By continuing to use this Site after any changes are posted, you are indicating your acceptance of those changes. “TIG” reserves the right to undertake all necessary steps to ensure the security, safety and integrity of TIG's systems as well as its clients' interests are and remain, well-protected. Towards this end, “TIG” may take steps to verify and confirm the authenticity, enforceability and validity of service requests placed by the User.

General Clauses

A User may travel to certain destinations which involve greater risks than others, entirely at his/her risk as to cost and consequences. It requests User to consult his/her local authorities and evaluate travel prohibitions, warning, announcements, and advisories issued by them before booking travel to those destinations. “TIG” reserves its exclusive right in its sole discretion to alter, limit or discontinue the ‘Website’ or any material posted herein, in any respect. It shall have no obligation to take the needs of any User into consideration in connection therewith. It reserves its right to deny in its sole discretion any User access to this ‘Website’ or any portion hereof without notice.

These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of India and any dispute shall exclusively be subject to the jurisdiction of the appropriate Courts situated at Gurugram, Haryana, India. Proceedings shall be in the English language.

Guest Booking Terms

Payments

All reservations shall be subject to cancellation if the concerned payments are not received by the due date. Upon receipt of advance deposit or complete payment, confirmation will be issued.

Payment Modes 

Electronic Funds Transfer is acceptable. Some banks may impose a Foreign Transaction Fee. This is an arbitrary fee that can occur in some cases. It is clarified “TIG” does not control these bank-imposed fees nor does it derive any benefit from them. 

Cancellation Policy

In the event of any cancellation, TIG’s rules of booking cancellations will apply, which can be informed at the time of booking, depending upon the nature of tour or sevices booked. 

Insurance:

Travel Protection or any kind of Insurances or claims shall be the individual responsibility of each guest.
